Tucson Photo Tickets Are Invalid

Tickets issued by scamera vendor ATS in the city of Tucson since August 14th are invalid. Citizens of the city should immediately begin requesting refunds.

In addition, anyone with a photo ticket issued during this time from the Tucson area should also request that their driving record be wiped clean of the alleged violation.

Why does Tucson or ATS think it is justifiable to issue tickets when there isn’t even an agreement in place for them to do so?

What would stop Redflex from dragging their little trailers out to Tucson and just start issuing violations for any reason they could come up with? If ATS can do it, why not at least try?

It’s been said over and over again on this website during the past two years, but this would be a good time to restate: ATS and Redflex are two criminal organizations illegally issuing photo tickets that violate your Constitutional Rights and for some unexplained reason, to this point it’s been allowed to go on. Is this episode of flaunting the law enough, or does everyone need to see more?

    Sounds like a great scam – ANYONE can take pictures of cars on a road and issue tickets now?

    Oh yes you have to photoshop in a timestamp and (very high) speed …

    Why should anyone be surprised? This is just business as usual. Who needs a contract to continue a scam? Just click and send an invalid notification and $$$$$ will roll in. The entire traffic enforcement system throughout the USA is all run illegally. Safety is never as important as revenue for the people and companies that have a job extorting American citizens and anyone else who gets caught in their web.

    I don’t know why Tucson citizens impacted by this decision have to “ask for a refund”. In my opinion ATS should be forced to refund every ticket in their system without those who have been scammed asking for their money back.

    A media contact informed me they researched this and the tickets ARE still valid.

    “… turns out the city of Tucson has a clause in the contract that basically means they continue as usual till a new contract is established. The tickets are not void.”

      First of all, I wouldn’t trust the media especially if they’re anything like AZ Central. Second, where is this so-called clause? I don’t see it in this particular contract unless there’s something more recent. And last, even if the media is trustworthy, we really can’t trust the media’s source, especially if it’s coming from ATS. The source (City or ATS) would lie through their teeth about something like this because we’re talking about a potential multi-million-dollar scam (or mistake).

      Attorneys reviewed the contract and disagree.

      If they want to say the contract is valid then that would mean there will be no price adjustment since it is effective upon the date of the
      Contract extension.

    Just wondering how a contract can be valid if it’s expired.. ???? Once expired, there IS NO contract until they make up a new one! When the contract expired for the freeway cameras, they got shut off on the same night… period. Friggin money-hungry scumbags!

      From the conversation, it sounded like the contract is required by city manager directive (purchases over $10K), not any legal requirement. So as long as both sides are interested in providing and receiving services, I think it just keeps on going and going.

      The potential downside for ATS is if Tucson comes back later and says, “we didn’t have a signed agreement therefore we’re not paying you”. But we all know how unlikely that is to happen.

      In the situation of DPS, they were clear that they were ending the contract for services by letting it expire.

      Perhaps a good way of dealing with this is contacting the city manager’s office and asking why he/she is allowing the police department to violate his/her directive. 🙂

    Upon further thought – if ATS is sending tickets on behalf of the police without a contract in place – it’s MAIL FRAUD. Who do you report mail fraud to? DPS or the FBI or someone else?

      Its definitely Extortion A.R.S. § 13-1804 but the State commits this thousands of times on a daily basis so contacting anyone from the State is laughable.

      There is NO one on the planet that extorts more than the State. If it were me I would report this to the FBI.

    Upon further thought, is ATS impersonating a peace officer? I think so:

    A person commits impersonating a peace officer if the person, without lawful authority, pretends to be a peace officer and engages in any conduct with the intent to induce another to submit to the person’s pretended authority or to rely upon the person’s pretended acts.
    ATS is inducing people to pay based on ATS’ pretend authority.

    Thanks to the Man in Black – Mark Spear

    He is really keeping on top of things over in Tucson.

    He was the one that notified us that the contract in Tucson had expired. He went to the media and city council and notified them that the contract signage is incorrect in front of photo radar cameras (2812204).

    He goes to the city council meetings and speaks out, he protests in the front of the vans, and has helped lots of people with their tickets.

      I live in Tucson and have been here since 1989. I have noticed in the past couple years that the speed limits all over town are been reduced by about 5mph or they are making more streets with the day/night speed limit.
