    The growing movement to ban these cameras will take massive input from angry motorists but we also need sharp legal minds to attack the technical aspects of this ripoff.

    The cameras have been taken down in some areas and the states are getting smarter in crafting their legal standpoint to perpetuate this farce.

    The masses need to fight every single ticket in court and overwhelm the system.
    Ignore the ticket until a processor serves you.

    Spend time crafting your defense, the better prepared you are the more apt the judge will dismiss you, just to get you out of his hair.

    Here’s a technicality. Does anyone know if redflex/ATS has been designated a “specialty peace officer” by DPS? If NOT, it is illegal for them to operate their vans on the side of the freeway because it is illegal to park there!

    Here’s another:
    By ARS 28-654, a photo van is required to have a sign at least 300 feet in front of the van. Of the van operations I’ve seen, I question whether or not the signage is that far in front of the van. ADDITIONALLY, if you went to court, could you argue that because you were not notified of the ticket until several days later that you had NO OPPORTUNITY to investigate whether or not the signage was legal?

    I’ve noticed a number of the photoradar vans without the proper signage. I ran up on one the other day that had the signs about 50 feet from the van and that was IT. I suspect they are told to not put up the proper signage so they can get more tickets. Ya know “take the risk that we will get 1 ticket thrown out in favor of giving an extra 20”

    So I checked and Redflex and ATS are not licensed as PI’s in Arizona either. In fact, I think every employee would have to be licensed as a PI. Here’s the one possible exception that I did find:

    ARS 32-2409 – Exemptions to PI License:

    11. A person or entity that is performing duties pursuant to statute and that is certified or registered by the supreme court.

    Is Redflex performing duties “pursuant to statute and that is certified or registered by the supreme court?”

    I am not sure that the supreme court has registered their duties. I am not sure how we would check.
